5th Circuit gives police new power in searches. "NEW ORLEANS -- A federal appeals court has opened the door for police in Texas and two other states to search residences and buildings for evidence without a warrant -- a ruling strongly criticized by two dissenting justices.

The 5th U.S. Circuit Court of Appeals ruled police do not need an arrest or search warrant to conduct a swift sweep of private property to ensure their safety."

That's what 15 years of Reagan/Bush appointees get you -- a federal bench which is packed with conservative ideologues. Clinton did little to reverse that -- he appointed "safe" (meaning, easy to confirm) moderates.

The federal courts have been taken over by the forces of reaction. If you want any justice for the little guy now, you almost have to use State courts.

And Ffej wonders why I see so little hope of the federal courts thwarting the will of Congress on file-sharing? Does he really expect these right wing ideologues to stick up for freedom of expression in the face of claims by business?

Ffej and I grew up in a time when federal courts were progressive, and activist. They're still activist, but now they're conservative. Asking them to do anything kinky on a business issue is just inviting a bad precedent. They are there to serve business.
