novell doing the right thing?

Novell tells SCO group to put up or shut up. novell had bought unix from ATT, sold it to SCO, which sold it to to Caldera. caldera renamed themselves SCO Group. But according to Novels open letter today they never owned the unix copyrights! great article form computerworld, describing the backpeddaling, and name calling full text of the letter from Novell's pres and ceo Messman:

"To Novell's knowledge, the 1995 agreement governing SCO's purchase of UNIX from Novell does not convey to SCO the associated copyrights," Messman said in the letter. "We believe it unlikely that SCO can demonstrate that it has any ownership interest whatsoever in those copyrights. Apparently you share this view, since over the last few months you have repeatedly asked Novell to transfer the copyrights to SCO, requests that Novell has rejected."

"Brave, Loyal, Generous"

Traditionally, those three adjectives were the finest things one Irishman could say about another. I'm a little more modern, so I use a more contemporary formulation: "He's the kind of guy I'd want covering my back in a prison riot" (with a nod to KNK for coining that expression for me.) You want someone who is fearless, absolutely trustworthy, and willing to give everything he's got for you.

I use that formulation on Oakey. I've known him since first grade, and he has never failed to meet that standard.

He fears nothing, and no-one. He'll give you the shirt off his back. And he'll always back you up, no matter what.

I think of one particular instance. His Dad was being tried on a heavy federal rap. He had exhausted his resources, because everyone else involved ratted out, and copped pleas. But Oakey's Dad refused to betray his former friends (even those who betrayed him,) so he was left twisting in the wind. That loyalty runs in the family.

Oakey had an extremely strained relationship with his Dad. But he was a young lawyer, still green, and there was no way he was going to let his Dad go down without a fight, especially when his Dad was acting so honorably (after a fashion, that is.) So, I remember reading in the newspapers about this young lawyer fighting like a junkyard dog to defend his Dad, who could no longer afford to hire a lawyer. He mixed it up big time with one of the federal judges here, known for his temper. But Oakey didn't give an inch. Of course, they went down in flames, and his Dad got a heavy sentence for his lack of "cooperation." But they went down fighting, and never yielded to betrayal.

Reading the news accounts, I thought "typical." Hardly typical of everyone, but certainly typical of the Oakeys. Bravery so wild that they fight a battle they're certain to lose. Loyalty so fierce that, even if you betray them, they will never betray you. And generosity so wide that they'll drop whatever they're doing, no matter how important, to come to your aid, even if you've betrayed them in the past.

Hey I actually got Holderman to give him 2 years off, the prosc wanted 8 and his law proffessor laywer was telling his to take it. A an old wise lawyer told me he should get better. So I went for it and got him 6. Holderman did not like me much then. I made sure to where somewhat loud polyester suits to just about every appearence. It really made me stand out in the sea of pin stripes.

But it was the post trial motions where Halderman and I got the most into it.

But that you so much for making me feel better.

jim, that's truely amazing. i had no idea you did that. i'm impressed. i really am. i followed the media coverage of parts of that, for personal reasons.

please go easy on Katherine, she's prepping for a show and getting her life in order to move to florida...she said she's never seen my page before, i had to walk her through posting. when it come to communications technology, she's at a lose, but she is learning fast.
